Re: Information Request 

Dear Marty:

In order to prepare for the upcoming grievance panel meeting I find it necessary to request the following information from United Parcel Service and Teamster Local 70.
 

  1. A copy of company manuals or guidelines that would indicate that the action being taken against me is nondiscriminatory. 
  2. Records of other employees, subjected to similar contract interpretation, which would indicate I am being treated in a fair and just manner. 
  3. Is the contract interpretation I am being subjected to non-discriminatory. Are these actions consistent with actions taken against other employees in a similar situation?
  4. Previous decisions, that have clarified contract interpretation, in cases similar to mine. 
  5. Is the notice of termination based on contract interpretation that is consistent with past practice that has been applied in a non-discriminatory manner? 
  6. For the union: Please provide me with a current copy of the Northern California Package Rider and the National Master Agreement between the Teamsters and UPS. (The contract is being requested under 29 U.S.C. 414 – Labor Management Reporting and Disclosure Act of 1959, as amended.)


Article 7, Section 2, paragraph (b) of the Northern California Supplemental Agreement allows UPS five days to comply with this request. Please advise UPS that refusals to provide relevant information, requested by the Union, or unreasonable delays in excess of 20 days, are unfair labor practices in violation of Section 8(a)(5) of the National Labor Relations Act. Please advise UPS that this request is being made without prejudice to the union's right to file subsequent requests. If any part of this letter is denied or if any material is unavailable, please have UPS provide the remaining items as soon as possible.

Please contact me when UPS responds so we can schedule a meeting to review their compliance.
